Privacy Policy

Be The Art Studio ("the Studio," "we," "us," or "our") is the fine art portrait and boudoir photography practice of Kabir Cardenas, based in Westlake Village, California. This policy explains what information we collect through betheartstudio.com, how we use it, and the choices you have. We've kept it plain, because trust is the whole point of this work.

Information we collect

We only collect what we need. When you reach out or book a consultation, you provide information directly — typically your name, email address, and anything you choose to share about the session you're imagining. If you schedule a call, that booking is handled through our scheduling provider (see "Third-party services" below).

When you book a session, payment is handled by our payment processor — your card details go directly to them under their own policies and are not collected or stored by us.

We do not run advertising trackers, and we do not build profiles of you across the web.

Analytics

To understand which pages are useful and how people find us, we use privacy-friendly, cookieless analytics. It measures aggregate activity — page views, referring sources, general region — without cookies, without storing personal data, and without tracking you across other websites. Because it sets no cookies and collects no personal information, there's no consent banner to click through.

Cookies

This site does not use tracking or advertising cookies. The only cookies you may encounter are functional ones set by our scheduling tool when you open it to book a call. You can control or clear cookies anytime through your browser settings.

Do Not Track

Some browsers offer a "Do Not Track" (DNT) signal. Because we don't run advertising trackers or third-party behavioral tracking in the first place, there's nothing for us to switch off — your activity here isn't followed across other websites, regardless of the setting.

How we use your information

We use the information you share to respond to your inquiry, schedule and prepare for your consultation, deliver our photography services, and handle billing for sessions you book. That's it. We do not sell or rent your personal information to anyone.

If you choose to opt in to emails from us, we'll only send what you signed up for, and every message includes an unsubscribe link you can use at any time.

Third-party services

A few trusted tools help us operate: our scheduling provider (for booking consultation calls), our email provider (for correspondence), an online gallery and image-delivery service (for viewing and delivering your photographs), and Instagram (if you choose to visit our profile). When you interact with these services, their own privacy policies apply to the data they handle.

Your photographs and confidentiality

This matters most, so we'll be direct. Sessions are private — one client, one photographer. There's no team, no assistants, no audience; only Kabir is present and behind the camera, and only Kabir handles your files. Your images are never sent to outside editors or retouchers.

Your images are private by default. We do not publish, post, display, or use any image of you — on this website, on social media, or anywhere — without your explicit, written permission. That permission is a separate, optional choice (a model release), limited to exactly the images and uses you approve, and you can withdraw it for future use at any time by emailing us. Finished images are delivered to you through a private gallery or link meant only for you. The full rights and handling of your images are set out in the photography agreement you sign before your session.

Data retention and security

We keep personal information only as long as needed to serve you and to meet legal or business requirements, then dispose of it responsibly. We use reasonable safeguards to protect the information in our care, though no method of transmission or storage is ever completely secure. If a data breach ever affects your personal information, we will notify you and any authorities as required by law, and explain the steps you can take to protect yourself.

Your privacy rights

Depending on where you live, you may have the right to access the personal information we hold about you, to request its correction or deletion, and to opt out of its sale or sharing. California residents have these rights under the California Consumer Privacy Act (CCPA/CPRA), including the right not to be discriminated against for exercising them. We do not sell or share personal information as those terms are defined under California law. To make a request, just email us — we'll respond within the timeframe the law requires.

Children's privacy

Our services and this website are intended for adults 18 and older. We do not knowingly collect information from anyone under 18. If you believe a minor has provided us information, please contact us and we will remove it.

Changes to this policy

We may update this policy as our practices or the law evolve. When we do, we'll revise the "last updated" date above. Material changes will be reflected here on this page.
