These terms govern your use of betheartstudio.com and your relationship with Be The Art Studio, the fine art portrait and boudoir photography practice of Kabir Cardenas, based in Westlake Village, California. By using this site or booking a session, you agree to them. Please read them before you proceed.

Eligibility

Our services and this website are intended for adults. You must be at least 18 years old to book a session or enter into a photography agreement with the Studio. We may require valid government photo ID to confirm your age before a session.

Use of this site

Please use this website lawfully and respectfully. You agree not to disrupt or damage the site, attempt to gain unauthorized access to it, or use its content in any way these terms don't permit. Your use of this site is also governed by our Privacy Policy.

Services

Be The Art Studio provides fine art portrait and boudoir photography. Every session is also governed by a separate photography agreement signed before your session date. That agreement controls the specific rights, deliverables, timelines, and conditions of your session; if anything here and in that agreement ever appear to conflict, the signed agreement governs your session.

Booking and payment

A reservation fee is required to hold your session date and is applied toward your collection. Reservation fees are non-refundable, but may be transferred to one rescheduled date with at least 7 days' notice. Collections begin at the prices shown on the site; full payment terms, including any plans, are set out in your photography agreement.

Cancellation and rescheduling

Life happens — if you need to reschedule, contact us as early as you can and we'll work with you wherever possible. Specific rescheduling windows and policies are detailed in your photography agreement.

Image rights, copyright, and confidentiality

The Studio retains copyright in all images created during your session. When you purchase a collection, you receive a personal-use license to the images in it — to print, display, and share them personally. You may not sell, license, enter into contests, or use the images commercially, or alter them in ways that materially change the work, without our written consent.

Your images are confidential. We will not publish or display any image that identifies you without your separate, written permission — see "Model release" below. The choice is always yours, and the full terms are set out in your signed photography agreement.

Model release

Any permission for us to publish or display identifiable images of you is granted only through a separate written model release that you choose to sign. Signing one is entirely optional and is never a condition of your session. Without it, your images remain private.

Conduct and safety

This is a collaborative, consent-based experience — you are in control of what you show and do throughout, and we photograph only what you're comfortable with. We reserve the right to end a session if anyone behaves in a way that is unsafe, harassing, or abusive, without refund.

All content on this website — text, photography, design, and code — is the property of Be The Art Studio and is protected by copyright. You may not reproduce, distribute, or use it without our written permission.

Third-party links and tools

This site links to third-party services, including our scheduling tool and Instagram. We are not responsible for the content, policies, or practices of those services; your use of them is governed by their own terms.

Disclaimers and limitation of liability

This website is provided "as is," without warranties of any kind. To the fullest extent permitted by law, Be The Art Studio is not liable for any indirect, incidental, or consequential damages arising from your use of the site. Nothing in these terms limits any liability that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to the site or these terms will be handled in the state or federal courts located in Ventura County, California.

Changes to these terms

We may update these terms from time to time. When we do, we'll revise the "last updated" date above, and the current version will always live on this page.

General

If any part of these terms is found to be unenforceable, the remaining terms stay in full effect. These terms, together with your signed photography agreement, make up the entire agreement between you and the Studio; where the two address the same subject, the signed agreement governs your session.
